These terms govern your use of Homfly and every order you place through it. Please read them — section 6 explains when an order actually becomes a contract, and section 9 covers cancellations and returns.
1. Who we are
This website and the Homfly application (together, the Platform) are operated under the business name Homfly Building & Interior Materials, a sole proprietorship business operating in Gurgaon, Haryana, India.
In these terms, “Homfly”, “we”, “us” and “our” mean the proprietor carrying on business under the name Homfly Building & Interior Materials; “you” means the person or business using the Platform.

2. Accepting these terms
By creating an account, placing an order, or otherwise using the Platform, you agree to these terms and to our Privacy Policy. If you do not agree with them, please do not use the Platform.
You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872. If you are using Homfly for a business, you confirm you are authorised to bind that business, and it is bound alongside you.
3. Your account
Accounts are created and accessed with your mobile number and a one-time password (OTP) sent to it. We do not use passwords for customer accounts, so anyone who can receive messages on your number can access your account. Keep your phone and your OTPs to yourself, and never share a code with someone claiming to be from Homfly — we will never ask you for one.
One mobile number is one account. You are responsible for everything done through your account, and for keeping the delivery addresses, contact details and GST registration details on it accurate. Tell us immediately if you believe your number or account has been compromised.
4. Where we deliver
Homfly currently delivers across Gurgaon. Delivery availability may vary based on the delivery location, product availability and operational conditions.
Delivery times shown on the Platform — including any “60 minute” or similar estimate — are good-faith estimates, not guarantees. They assume stock on hand, a reachable site and normal conditions. Traffic, weather, restricted entry to a site or building, local restrictions and events beyond our reasonable control will move them.
5. Products, prices and taxes
Prices shown on the Platform are in Indian Rupees and are inclusive of GST unless a screen says otherwise. Delivery charges, where they apply, are shown separately before you commit to an order.
Prices, product descriptions, specifications, brand availability and stock change frequently, and we may change them at any time before an order is confirmed. Product images are indicative — packaging, batch markings and shade can vary between production runs, particularly for paints, tiles and cement.
We take care with the catalogue, but errors happen. If a product is listed at an obviously incorrect price or with materially wrong specifications, we may cancel or decline the affected order even after you have placed it, and we will refund anything you have paid for it in full.
A GST invoice is issued for every completed order. To have your GSTIN appear on it, add your GST registration details to your profile before the order is invoiced — we cannot re-issue an invoice against a different GSTIN afterwards.
6. How an order is formed
Adding items to your cart and submitting them is an offer to buy, not a concluded contract. What you receive at that point is a quotation.
A contract of sale is formed only when we confirm the order to you — on WhatsApp, by phone, or by moving it to a confirmed state you can see on the order screen. Until then we may decline the order or any part of it, including where stock has run out, the address turns out to be outside our serviceable area, the price was wrong, or we cannot reasonably verify the order.
Where you place an order through WhatsApp or over the phone, the same rule applies: the order exists once we confirm it back to you, and the items, quantities and total in that confirmation are what govern.
7. Payment
Depending on the order and the products in it, we accept online payment (UPI, cards and net banking, processed by our payment gateway), payment against a payment link we send you, and — where a product and your area both allow it — payment on delivery.
Online payments are processed by third-party payment gateways. We do not receive or store your card number, UPI PIN, or bank credentials; those go directly to the gateway, and the gateway's own terms and privacy policy apply to that part of the transaction.
Where payment on delivery is offered, payment is due in full at the time of delivery, before the goods are unloaded. We may withdraw payment on delivery for any order, customer or area at our discretion — for example after a pattern of refused deliveries.
8. Delivery, access and the delivery code
You are responsible for making delivery possible. That means:
- giving a delivery address and location that can actually be found and reached by a loaded vehicle;
- having someone at the site who is authorised to receive the goods during the delivery window;
- arranging any building, society, RWA or site permission needed for a delivery vehicle to enter.
Unloading, carrying and stacking are not included. Our delivery is to the point the vehicle can safely reach. Anything beyond that — lifts, stairs, carrying to a floor — is for you to arrange unless we have agreed otherwise in writing.
Some deliveries are completed against a one-time delivery code shown on your order screen. Sharing that code with the delivery executive confirms you have received the goods. Do not share it before the goods are with you.
If nobody is available to receive a delivery, or the site cannot be reached, we may return the goods to the warehouse and charge a reasonable re-delivery or restocking charge for a second attempt.
Risk in the goods passes to you on delivery. Title passes on delivery or on our receipt of payment in full, whichever is later.
9. Checking your delivery
Construction materials are heavy, breakable and often perishable in a practical sense — cement in particular has a shelf life and is ruined by damp. So please check your delivery at the time it arrives, before the delivery executive leaves.
Report any shortage, wrong item, or visible damage to us within 24 hours of delivery, with photographs of the goods and their packaging. Claims for visible damage or shortage raised after that are very difficult for us to verify and may not be accepted.
10. Cancellations, returns and refunds
Cancelling. You may cancel an order at no charge at any time before it has been dispatched — message us on WhatsApp or call +91 7303683067. Once a delivery is on its way we may not be able to stop it; if it has already left the warehouse, a reasonable charge for the trip may apply.
What we take back. We will replace, or refund, any item that arrives damaged, is not what you ordered, is short in quantity, or is materially defective, once it has been reported within the window above.
What we cannot take back. For reasons of safety and product integrity, we do not accept returns of: cement and other bagged binders once the bag is opened or has been exposed to damp; paints, adhesives and chemicals once tinted, mixed or opened; items cut, mixed or made to your measurement; and any product returned in a condition that makes it unsaleable.
Refunds. Approved refunds go back to the original payment method. Allow up to 7 business days from approval for the money to appear, depending on your bank or UPI provider. Where you paid on delivery, we will refund by bank transfer or UPI to an account you confirm to us.
11. Warranties
Manufactured goods carry the warranty their manufacturer gives them, and nothing in these terms reduces your rights under the Consumer Protection Act, 2019. Beyond that, and to the extent the law allows, the Platform and everything sold through it are provided without further warranty — including any implied warranty of fitness for a particular construction purpose. Choosing the right grade, specification or quantity for your work is your decision or your contractor's; product specifications on the Platform are reproduced from the manufacturer and are for reference.
12. How you may use the Platform
You agree not to:
- place orders you do not intend to pay for or receive;
- use someone else's number, payment instrument, GSTIN or identity, or misrepresent who you are;
- scrape, copy, resell or systematically extract the catalogue, pricing or any other part of the Platform;
- probe, disrupt, overload or attempt to gain unauthorised access to the Platform or the systems behind it;
- use the Platform for anything unlawful, or in a way that harms Homfly, our staff, our delivery partners or other customers.
We may suspend or close an account, cancel orders, and refuse further service where we reasonably believe any of the above has happened.
13. Our content and brand
The Platform, its design, text, graphics, product photography, and the Homfly name and logo belong to us or to our licensors and are protected by intellectual property law. You may use them only as needed to use the Platform as a customer. Third-party brand names and product images belong to their respective owners and appear here to identify the goods we sell.
14. Liability
Nothing in these terms excludes liability that cannot be excluded by law — including for death or personal injury caused by our negligence, or for fraud.
Subject to that, we are not liable for indirect or consequential loss, and specifically not for loss of profit, loss of contract, project delay, standing time for labour or equipment, or liquidated damages you owe a third party, however caused.
Our total liability arising out of or in connection with any order is limited to the amount you paid for that order.
15. Events outside our control
We are not responsible for failing to perform, or for delay in performing, where the cause is outside our reasonable control — including natural events, fire, flood, epidemic, strikes, civil unrest, government or municipal restrictions, road closures, failures of telecommunications or payment infrastructure, and supplier or transport failure. Where such an event affects an order, we will contact you and either agree a new time or cancel and refund it.
16. Changes to these terms
We may update these terms as the service changes. The version in force is the one published on this page, and the date at the top tells you when it last changed. Continuing to use the Platform after a change means you accept the updated terms. Orders already confirmed are governed by the terms in force when they were confirmed.
17. Governing law and disputes
These terms are governed by the laws of India. The courts at Gurgaon, Haryana have exclusive jurisdiction over any dispute arising out of them.

18. Grievance officer
In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, complaints about the Platform can be sent to our grievance officer:
